Following the death of a loved one or relative, it usually falls upon members of the family or close friends to take the necessary steps to deal with the estate of the deceased. The need, or otherwise, to make an application for Probate, will depend upon the nature and value of the estate.

Probate is simply an Order of the Supreme Court authorising executors to realise the assets of the estate and then to distribute the estate in accordance with the requirements of the Will.

This course will guide you through critical information to understand the process, complexities and associated risks when dealing with probate. The course is divided into 6 modules titled:

  • Topic 1: Getting started
  • Topic 2: Receiving instructions
  • Topic 3: Commencing proceedings
  • Topic 4: Drafting and affirming the affidavit of the executor
  • Topic 5: Filing the application for grant of probate

At the end of this course, you will be able to:

  • Advise a client on the application for probate processes
  • Attain the documentation and detail from the client essential to the probate application
  • Prepare the documents required for an application for probate
  • Follow each step to file an application for probate

At the end of this on-demand course, you may claim 2 CPD points. Please consult the CPD rules for your State/Territory to ascertain how many CPD points you can claim for private study of audio/visual material during the CPD year.  

Due to new reporting requirements introduced by the Legal Practice Board of Western Australia on 1 April 2021, practitioners holding WA practising certificates are not currently eligible to claim CPD points for this product.

Claiming CPD units

If you intend to claim CPD units for this educational activity, please note that CPD activities are not accredited by the Law Society of NSW or any other equivalent local authority. If this educational activity extends your knowledge and skills in areas that are relevant to your practice needs or professional development, then you should claim one (1) "unit” for each hour of attendance, refreshment breaks not included. The annual requirement is ten (10) CPD units each year from 1 April to 31 March. Some practitioners, such as accredited specialists are required to complete more than ten (10) units each CPD year.
