In this short course, you will learn about commercial leases; that is, leases of premises that are to be used for commercial as distinct from residential purposes, such as shops, factories and offices. 

This course is confined to leases of land under the Transfer of Land Act 1958 (Vic) (TLA). The terms and conditions of leases of land under the general law system of title, Crown land and reserved Crown land are substantially similar to leases of land subject to that Act.

This course is divided into 6 modules where you will explore:

  • Getting started – knowing the basics
  • Receive instructions
  • Retail Leases Act 2003 (VIC)
  • Prepare and submit the lease
  • Negotiate and amend the lease
  • Execute and register the lease

On completion of this course you will be able to:

  • Advise a client on entering into a commercial lease from both landlord’s (lessor) and tenant’s (lessee) perspectives
  • Determine whether the Retail Leases Act 2003 (VIC) will apply to the transaction
  • Carry out the steps in a commercial lease starting from receiving instructions through to registration
  • Identify the amendments required to a lease clause

At the end of this on-demand course, you may claim 2 CPD points. Please consult the CPD rules for your State/Territory to ascertain how many CPD points you can claim for private study of audio/visual material during the CPD year.

Due to new reporting requirements introduced by the Legal Practice Board of Western Australia on 1 April 2021, practitioners holding WA practising certificates are not currently eligible to claim CPD points for this product.

Claiming CPD units

If you intend to claim CPD units for this educational activity, please note that CPD activities are not accredited by the Law Society of NSW or any other equivalent local authority. If this educational activity extends your knowledge and skills in areas that are relevant to your practice needs or professional development, then you should claim one (1) "unit” for each hour of attendance, refreshment breaks not included. The annual requirement is ten (10) CPD units each year from 1 April to 31 March. Some practitioners, such as accredited specialists are required to complete more than ten (10) units each CPD year.
