Family Law Practice

 

What is this subject about?

Family practice involves:

  • advising clients about matters arising from the breakdown of a marriage or other marriage-like relationships, and
  • resolving disputes about family law problems through the court system or alternative dispute resolution processes.

The aim of this subject is to assist you to become competent in the following elements of family practice:

  • obtaining a divorce order 
  • acting in relation to matters relating to parenting, property settlement, child support and spousal maintenance.

What will I learn and what skills will I have the opportunity to practise?

This subject covers the fundamental processes in family practice, which will enable you to act competently for clients in family law matters and includes:

  • applications for divorce, and 
  • applications concerning parenting matters, property settlements, spousal maintenance and child support.

Unit 1: Taking Instructions, Preparing and Presenting an Application for Divorce

Unit 3: Advising on Financial Matters

Unit 4: Documenting and Finalising Agreements

Please note that some activities will be conducted in an onsite workshop. Before you attend the workshop, you must complete the online exercises and reading in each unit.

How will I be assessed?

Assessment in this subject will be based on:

  • assessment of court appearance (60%)
  • assessment of file note of advice (40%)
