Damages in Building Contracts

This seminar looks at the general principles that apply to damages, including what can be recovered and how are damages quantified; defect work and pitfalls with liquidated damages; the decision in Tabcorp Holding v Bowen Investments (2009) and the fine line between liquidated damages and penalties.

Alex Ostermayer (BA (Hons), LLB (Uni of Sydney)) is a Partner in the Construction and Engineering Division of Colin Biggers & Paisley, a leading Sydney law firm.

He was admitted as a solicitor in 1977 and joined Colin Biggers & Paisley as a partner in 1995. Alex is an experienced commercial lawyer and has been actively involved in construction and engineering law since his admission. Being fully conversant with financial and commercial matters, he specialises in project development and documentation, as well as providing ongoing contract administration advice. He is experienced in major infrastructure projects and in the export of construction services to South East Asia and the Middle East, having recently spent 18 months in Dubai establishing CBP's UAE offices. Alex is a member of the Institute of Arbitrators and Mediators Australia.
