FLP12 Advanced Issues in Property, Maintenance and Child Support

This advanced subject examines in-depth issues in complex property and financial matters, one of the most complex areas of family law practice.
At the end of this subject you will be equipped to advise your clients on the more complex issues impacting on matters that involve property and financial issues.
What will I learn while studying this subject?
At the end of this subject you will be able to:
- demonstrate an advanced and in-depth knowledge of the substantive law in regard to family law matters involving complex property and financial issues, such as cross-border issues, trusts, partnerships and binding third parties
- be familiar with the process of having orders and agreements set aside
- confidently manage matters involving special skills and/or large amounts of money
- demonstrate an in-depth knowledge of issues impacting the determination of spouse maintenance
- manage issues arising in property disputes arising from the breakdown of de facto relationships

- Issues in the definition of property
- Trusts, private companies and partnership interests
- Power to bind third parties
- Competing claims, creditors and bankruptcy
- Expert evidence in financial matters
- Setting aside orders and agreements
- Cross-border issues in family property law
- Big money/special skills cases
- De facto property disputes
- Advanced spouse maintenance – lump sum claims and large periodic orders
How will I be assessed?
This subject has the following assessments:
- matters involving a third party (20%)
- advising on a binding financial agreement (20%)
- written examination (60%)
If you enrol in this as a single subject on a non-award basis then you do not have to complete the assessment.
