What is this subject about?

This subject covers a range of issues arising for commercial litigation practitioners during the conduct of matters involving complex litigation.

This subject aims to provide the knowledge and skills needed to manage complex matters calling for the use of new and emerging technologies in case preparation and presentation.

What will I learn while studying this subject?

At the end of this subject you will be able to:

  • confidently manage matters calling for the use of new and emerging technology in case preparation and case presentation
  • apply privilege principles (legal professional privilege, privilege against self-incrimination and privilege against exposure to penalties) to both pre-trial matter management and the conduct of litigation
  • discern and evaluate the legal and practical issues which arise in class actions and other multi-party litigation
  • advise on issues relating to the conduct of international litigation and arbitration, including the drafting of dispute resolution clauses, conduct of arbitrations and enforcement of arbitral awards and foreign judgments

Assessment in this subject will be based on:

  • satisfactory participation in the program

  • drafting exercise (20%)
